1) About Us
These Terms govern your use of services provided by My Xplore LLC (“My Xplore”, “we”, “us”).

2) Acceptance of Terms
By using our website or purchasing/using any VPS service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our services.
3) Services
- We provide VPS hosting with the specifications shown on our site at purchase time.
- Network and datacenter locations may vary by availability.
- Features like snapshots/backups are provided as convenience tools; you are responsible for your own data protection.
4) Accounts & Security
- You must provide accurate information and keep your credentials secure.
- You are responsible for all activity under your account, including content hosted on your VPS.
- Maintain your own backups; verify snapshots/restores before critical changes.
5) Acceptable Use
- No illegal content or activity; no infringement, malware, phishing, or child sexual abuse material.
- No unsolicited bulk email (spam), traffic amplification, open relays/proxies meant for abuse, or activity that degrades network/service for others.
- No attempts to attack or probe others (e.g., DDoS, port scanning, brute force) except on assets you own with explicit authorization.
- We may suspend or terminate accounts that violate this section or applicable law.
6) Payments & Refunds
- Prices are in USD. Our plans are one-time payments (no automatic renewals).
- Taxes/fees (if any) are shown at checkout.
- 30-Day Money-Back: Initial purchases are eligible for a full refund within 30 days. Renewals or upgrades are not refundable. Accounts suspended for fraud or Terms violations are not eligible.
- To request a refund, email support@the-xplore.com. Refunds are issued to the original payment method within 7–10 business days after approval.
7) Fair Use & Resource Limits
- Plans include a 1 Gbps port, with 32 TB outbound fair-use and unlimited inbound traffic (reasonable/non-abusive use).
- If usage harms network stability or violates these Terms, we may rate-limit, request changes, or suspend service.
8) Uptime & Maintenance
- We target 99.9% service availability. Scheduled or emergency maintenance may occur.
- We will use reasonable efforts to notify customers of impactful maintenance.
9) Support
- Support is available 24/7 via email or our contact form. Average first response is typically under one hour.
- For faster help, include your account email, server ID, and a short description of the issue.
10) Privacy
We collect the minimum information needed to provide the service. See our Privacy Policy for details.
11) Suspension & Termination
- You may cancel at any time. After 30 days, payments are not refundable, but service remains active for the paid period (where applicable).
- We may suspend or terminate service for violations of these Terms or law, or to protect the platform and other users.
- Upon termination, your access may be disabled and data may be deleted. Keep your own backups.
12) Disclaimers
- Except as expressly stated, services are provided “as is” and “as available”.
- We do not guarantee that services will be error-free or uninterrupted at all times.
13) Limitation of Liability
To the maximum extent permitted by law, My Xplore is not liable for indirect, incidental, or consequential damages, lost profits, or data loss. Our total liability for any claim relating to the services is limited to the amount you paid for the affected order.
14) Indemnification
You agree to indemnify and hold My Xplore harmless from claims or losses arising from your content, your use of the services, or your violation of these Terms or applicable law.
15) Governing Law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflicts of law. Courts located in Wyoming will have exclusive jurisdiction.
16) Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted on this page. Your continued use of the services means you accept the updated Terms.
